Class Action Certified Against Home Care Network, Inc.

On June 5, 2017, the U.S. District Court granted Plaintiff’s motion to certify a class action of all home health care workers who worked for Home Care Network, Inc. throughout the state of Ohio between January 1, 2015 and April 30, 2016. This ruling is likely to affect hundreds of home health care workers in the state of Ohio.

The plaintiff is a former home health care worker for Home Care Network who was paid her “straight-time” (i.e. no time and a half for overtime hours) hourly rate for all hours worked, including hours worked over 40 hours per week. As of January 1, 2015, the law changed to require third-party home care providers to pay time and one half overtime wages to home health care workers when they work over 40 hours per week. However, the plaintiff alleges that Home Care Network continued to pay her and her co-workers their regular hourly rate for all hours worked.

By granting class certification, the court has given plaintiff permission to pursue back wages not just for herself, but for all of her fellow home health care workers who were also denied their proper wages.
