Approval Sought for Duke Energy Class Action Check Distribution
Plaintiffs’ counsel filed a motion requesting the approval of Chief Judge Edmund A. Sargus Jr. to allow for distribution of settlement checks totaling approximately $50 million in the Duke Energy Class Action Settlement (www.dukeclassaction.com). If approval is given, checks should begin to be sent within a few weeks, and it should take approximately three weeks for over 200,000 checks to be distributed. Residential claimants who paid Duke tariffed electricity rates for the entire class period of 2005-2008 will receive approximately $140. Non-residential claimants may receive more based on their usage during the class period.
“We are incredibly pleased with the success of the settlement. Participation far exceeds what is normally found in consumer class actions, which is a recognition of the significant cash payments class members will receive,” said Bill Markovits, lead counsel for the plaintiffs and a founding partner of Markovits, Stock & DeMarco.
