Markovits, Stock & DeMarco Files a Class Action Lawsuit against NordicTrack Based on its False and Misleading Claims of Treadmill Horsepower

On November 22, 2019, the attorneys at Markovits, Stock & DeMarco, along with co-counsel, filed a class action lawsuit against NordicTrack based on NordicTrack’s misleading horsepower representations in advertising, marketing, and selling their treadmills to everyday consumers. The lawsuit alleges nationwide warranty claims and state-based warranty and consumer protection claims against NordicTrack. The lawsuit seeks, among other forms of relief, an order from the court stopping NordicTrack from continuing to promote its treadmills using false and misleading horsepower representations.

NordicTrack promotes and emphasizes in its advertising the horsepower capabilities of its treadmills, from 2.5 continuous horsepower to 4.25 continuous horsepower, and charges a premium based on these claims.
