Alternative Dispute Resolution

For many parties, dispute resolution involves arbitration or mediation, rather than a courtroom. Arbitration is a voluntary, binding process and generally less formal than court proceedings. Different types of contracts frequently mandate arbitration as the means of resolving disputes. Mediation, by contrast, is not binding, but a voluntary progress in which the mediator works with the parties to try to find common ground to resolve the dispute.

Alternative Dispute Resolution (ADR) includes arbitration, mediation, and other means of resolving disputes outside of the judicial process.

Meet Pierre Bergeron

Serving as an arbitrator on the American Arbitration Association panel, Pierre Bergeron has chaired multiple 3-arbitrator panels and arbitrated healthcare (particularly payor-provider disputes), energy, commercial, professional athlete, and family business disputes. These include many high-dollar complex cases, including cases with over $1 billion in claimed damages at stake. He is accustomed to managing complex cases and moving them forward efficiently and expeditiously.

Pierre has extensive mediation experience and structuring complex settlements. As a judge, Pierre spearheaded the creation of the First District Court of Appeals’ mediation program. Recognizing the value of mediation from his considerable experience in mediation as an advocate, Pierre researched appellate mediation programs and secured funding from the Ohio Supreme Court to launch the mediation program. Since leaving the bench, parties have engaged Pierre to assist them in settling complex business disputes. These disputes include commercial, probate, non-compete, commercial real estate, trust, restaurant industry, and education-related cases. Pierre understands how to navigate complicated, and often emotionally-fraught, cases, and he works tirelessly to steer the parties towards resolution.

Pierre is a recognized leader in ADR-related work and recently served on the Ohio Supreme Court’s Dispute Resolution Commission.
