Terry Coates Selected as Interim Liaison Counsel in EyeMed Data Breach Case

On March 22, 2021, Judge Douglas R. Cole, United States District Judge for the Southern District of Ohio, selected Markovits, Stock & DeMarco, LLC attorney Terry Coates to serve as Interim Liaison Counsel in the consolidated multi-state class action, Tate v. EyeMed Vision Care, LLC, No. 1:21-cv-00036-DRC (S.D. Ohio). This litigation arises out of EyeMed’s alleged failure to exercise reasonable care to safeguard Plaintiffs’ and absent class members’ personally identifiable information, including their protected health information. Despite the heightened risk for data breach vulnerabilities as a vision care benefit provider, Plaintiffs allege EyeMed did not have appropriate measures in place to protect against a data breach.  As a result, beginning on June 24, 2020 and for roughly a week thereafter, EyeMed experienced a data breach that allowed unauthorized persons to access at least hundreds of thousands of its customers’ personal information, including potential health insurance information, social security numbers, and medical conditions and history. EyeMed became aware of the breach on July 1, 2020, but did not inform its customers about the breach until December of 2020.
