FIVE RIVERS DATA BREACH CLASS ACTION

Markovits, Stock & DeMarco, LLC is investigating the potential filing of a data breach class action against Five Rivers Health Centers (“Five Rivers”) on behalf of patient victims whose sensitive personal and medical information was exposed in a recent data breach.

WHAT HAPPENED?

On May 28, 2021, Five Rivers began notifying patients about a data breach resulting from a phishing email incident. A copy of Five Rivers’ Notice Regarding Security Incident can be viewed here.[1]

Five Rivers publicized that even though the data security breach occurred between April 1, 2020 and June 2, 2020, it didn’t discover the problem until almost a year later on March 31, 2021 and didn’t notify the affected patients until May 28, 2021.[2] The notice does not explain why the unauthorized access was gained over a year ago and just reported to affected patients on May 28, 2021.

WHAT DATA IS INVOLVED IN THE FIVE RIVERS DATA BREACH?

The Notice Regarding Security Incident states that victims of the breach contained the following personal and/or protected health information:

  • Name,
  • Date of Birth,
  • Address,
  • Medical Record Number,
  • Patient Account Number;
  • Medical diagnosis,
  • Treatment and/or clinical information,
  • Test results or lab reports,
  • Provider information,
  • Date of service,
  • Treatment cost information,
  • Prescription information,
  • Health insurance information and/or policy numbers, and,
  • Medicaid or Medicare numbers.[3]

Furthermore, Financial account numbers, payment card numbers, driver’s license or state identification number, and/or Social Security Number were included in the breach for some patients.[4]

According to the U.S. Department of Health & Human Services, approximately 155,748 patients are affected by the Five Rivers data breach.[5]
