On June 22, 2021, Markovits, Stock & DeMarco and its co-counsel filed a data breach class action on behalf of Plaintiffs Heather Bowen and Benjamin F. Liang against 20/20 Eye Care Network, Inc. and iCare Health Solutions, LLC in the United States District Court for the Southern District of Florida. A copy of the class action complaint may be found here. 20/20 Eye Care Network is a large corporation that acts as a third-party administrator with respect to hearing and vision insurance, and assists insurance companies and patients with claims processing, credentialing of professionals, and linking patients with in-network providers.
On or about May 29, 2021, 20/20 Eye Care Network, Inc. reported to the California Attorney General that a data breach involving patients’ confidential, personal information was obtained by unauthorized third parties, specifically social security numbers, Member Identification numbers, dates of birth, and health insurance information (“PII”). The breach occurred on or about January 11, 2021, meaning that more than 4 months passed before the breach was actually disclosed to those individuals whose PII was included in the Data Breach. The Data Breach impacted more than 3.2 million individuals.
Plaintiffs seek damages on behalf of themselves and the class they seek to represent resulting from 20/20 Eye Care Network’s negligent disclosure of their confidential personal information.
