Over $2 Billion Recovered For Clients

Terry Coates Selected to the Plaintiffs’ Executive Committee in the 20/20 Eye Care Data Breach

On Behalf of Markovits, Stock & DeMarco, LLC | Jul 15, 2021 | Class Action, Firm News

On July 14, 2021, Judge Rodolfo A. Ruiz II, United States District Judge for the Southern District of Florida named Markovits, Stock & DeMarco, LLC attorney Terry Coates to the Plaintiffs’ Executive Committee in the consolidated data breach class action case Desue v. 20/20 Eye Care Network, Inc., No. 21-CV-61275-RAR (S.D. Fla.).  A copy of Judge Ruiz’s decision may be viewed here.

The Desue case arises out of 20/20 Eye Care’s alleged failure to exercise reasonable care to safeguard Plaintiffs’ and absent class members’ personally identifiable information, including their protected health information.

On or about May 29, 2021, 20/20 Eye Care Network, Inc. reported to the California Attorney General that a data breach involving patients’ confidential, personal information was obtained by unauthorized third parties, specifically social security numbers, Member Identification numbers, dates of birth, and health insurance information (“PII”). The breach occurred on or about January 11, 2021, meaning that more than 4 months passed before the breach was actually disclosed to those individuals whose PII was included in the Data Breach. The Data Breach impacted more than 3.2 million individuals.

Plaintiffs seek damages on behalf of themselves and the class they seek to represent resulting from 20/20 Eye Care Network’s negligent disclosure of their confidential personal information.

If you or anyone you know received a notification from 20/20 Eye Care Network about this data breach and you would like additional information about your legal rights, please contact Markovits, Stock & DeMarco attorney Terry Coates: (513) 665-0204; [email protected].
