Markovits, Stock & DeMarco, LLC, a law firm experienced in class action litigation, is investigating allegations that Clarolux, Inc., a company headquartered in North Carolina, deceptively marketed certain products as “Made” or “Built” in the USA. ClaroLux does business under the name ClaroLux Landscape Lighting.
On June 5, 2023, the Federal Trade Commission (FTC) issued a letter to ClaroLux stating that it has concerns marketing materials published by ClaroLux “may have overstated the extent to which ClaroLux’s outdoor lighting products are made in the United States.”[1] The letter from the FTC states that, “[s]pecifically, among other things, certain ClaroLux products incorporate significant imported materials including, but not limited to, LED components and other lighting parts.”[2]
The FTC states in its letter that it has decided not to pursue legal action against ClaroLux because ClaroLux has agreed to (1) stop using potentially misleading language when advertising the national origin of its products, (2) conduct companywide compliance training, and (3) implement a multi-person approval process for labeling and packaging its products.[3]
Although ClaroLux has promised not to engage in conduct that might violate the law moving forward, this does nothing to compensate consumers who may have overpaid for products with the understanding that they were purchasing American made goods.
