Arbitration In Ohio

Arbitration serves as a method of resolving conflicts outside of conventional court systems, known as alternative dispute resolution. This process includes an impartial individual, referred to as an arbitrator, who hears the arguments from both parties and delivers a decision that is binding for all involved. Commonly used to resolve commercial disputes, employment matters and consumer disagreements, arbitration provides a private, efficient and often more amicable way to resolve disputes compared to litigation.

Arbitration is a voluntary process and generally less formal than court proceedings. Disputing parties may come to arbitration via various commercial contract clauses or mutual consent. Different types of contracts frequently mandate arbitration as the first step in resolving disputes.

Parties typically select an arbitrator or a panel of arbitrators with the help of legal counsel. Arbitrators are usually individuals with significant knowledge in the field related to the dispute. Arbitration allows for flexible procedures and can be faster and less costly than litigation.

Ohio law, including the Ohio Arbitration Act, governs arbitration proceedings. In most cases, the arbitrator’s decision is final and binding, with limited grounds for appeal. This is unlike mediation, where the mediator facilitates negotiation but does not make decisions.

Courts may become involved to enforce arbitration agreements, confirm arbitration awards or address issues like arbitrator bias.
