Second Avenue Landlord-Tenant Class Action Investigation

Markovits, Stock & DeMarco, LLC, a law firm experienced in complex class action litigation, is investigating claims on behalf of current and former tenants of “Second Avenue” regarding potential violations of state and local law, including the Ohio Landlord Tenant Act (“OLTA”) and Cincinnati Municipal Code (“CMC”).

What Happened?

This case involves what’s known as “single-family rentals.” Second Avenue owns, operates, maintains, and rents residential properties. In Hamilton County alone, its portfolio surpasses 200 single family homes.

In recent months, allegations have emerged from current and former tenants regarding Second Avenue’s rental practices. On August 21, 2025, a class action complaint was filed against Second Avenue in the Hamilton County Court of Common Pleas.[1]

What is MSD Investigating?

We are investigating claims from current and former tenants that Second Avenue may have violated state and local law by, among other things:

  • including lease terms that violate state and/or local law;
  • failing to comply with maintenance obligations; and
  • charging and collecting improper fees, which can ultimately result in improper evictions.
